Agreement To Our Legal Terms.

We are Abodu Homes, Inc. ("Abodu Homes," "we," "us," or "our"), a company registered in California at 9903 Santa Monica Boulevard, Suite 2400, Beverly Hills, California 90212. We operate this website and related products and services that link to these terms (collectively, the "Services"). By using the Services you agree to be bound by these terms. If you do not agree, do not use the Services. We recommend printing a copy for your records.

Our Services.

Information provided through the Services is not intended for use in any jurisdiction where such use would be contrary to law or would subject us to a registration requirement. The Services are not tailored to comply with industry-specific regulations such as HIPAA or FISMA, and may not be used in violation of the Gramm-Leach-Bliley Act.

Intellectual Property Rights.

We own or license all intellectual property in the Services, including source code, software, designs, text, photographs, floor plans, graphics, and trademarks. Subject to these terms, you may access the Services for your personal, non-commercial use. No part of the Services may be copied, reproduced, republished, or exploited for any commercial purpose without our express prior written permission.

User Representations.

By using the Services you represent that you have legal capacity to agree to these terms, you are not a minor in your jurisdiction, you will not access the Services through automated means, and you will not use the Services for any illegal or unauthorized purpose.

Products: Important Notice Regarding ADU Sales.

Any product-purchase provisions in these terms apply only to consumer merchandise available for purchase directly through the site. The purchase, manufacture, and installation of Abodu ADU units are not governed by these terms. They are governed exclusively by your separate written Home Improvement Contract, which includes the specific cancellation rights required by California law.

We make every effort to display product colors, features, specifications, and pricing accurately, but we do not guarantee that displayed details are complete, current, or error-free, and all products are subject to availability.

Purchases, Payment, And Returns.

You agree to provide current and complete purchase information and authorize us to charge your chosen payment provider. We may refuse or limit orders in our discretion, including orders that appear to be placed by dealers or resellers. For consumer merchandise purchased directly on the site, all sales are final and no refund will be issued. Deposits or payments toward an ADU construction project are subject to the cancellation and refund terms in your Home Improvement Contract, in compliance with California Business and Professions Code section 7150 et seq.

Prohibited Activities.

You may not use the Services other than for their intended purpose. Among other things, you agree not to:

• Systematically scrape, harvest, or compile data or content from the Services without written permission
• Circumvent or interfere with security or access-restriction features
• Upload viruses or other malicious code, or use the Services to transmit passive collection mechanisms
• Impersonate another user, use another person's information, or trick, defraud, or mislead us or other users
• Harass, intimidate, or threaten anyone providing any portion of the Services to you
• Copy, adapt, decompile, or reverse engineer the Services' software except as permitted by law
• Use the Services in any effort to compete with us or for any revenue-generating endeavor we have not approved

Submissions.

If you send us questions, comments, ideas, or other information, you grant us the right to use them without restriction or compensation, you warrant they are original to you or that you have the right to submit them, and you agree they are not confidential.

Third-Party Websites And Content.

The Services link to third-party websites, including government resources cited in our city guides. We are not responsible for third-party content, accuracy, or practices, and a link is not an endorsement. Regulatory summaries on this site are provided for general information and are not legal advice; confirm current requirements with the relevant jurisdiction.

Services Management; Term And Termination.

We may monitor the Services for violations, restrict or disable access, and manage the Services to protect our rights and their proper functioning. These terms remain in effect while you use the Services, and we may deny access to anyone at any time for any lawful reason, including breach of these terms.

Modifications And Interruptions.

We may change, suspend, or discontinue any part of the Services at any time without notice, and we do not guarantee the Services will be available without interruption, delay, or error.

Governing Law.

These terms are governed by the laws of the State of California applicable to agreements made and performed entirely within California, without regard to conflict-of-law principles.

Dispute Resolution.

Informal Negotiations. To expedite resolution and control cost, you and Abodu Homes agree to first attempt to negotiate any dispute related to these terms informally for at least thirty days before initiating arbitration, beginning upon written notice from one party to the other.

Binding Arbitration. If the parties cannot resolve a dispute through informal negotiations, the dispute (except those expressly excluded) will be finally and exclusively resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association and, where appropriate, its Consumer Arbitration Rules. You understand that without this provision you would have the right to sue in court and have a jury trial. The arbitration will take place in Los Angeles County, California.

Exceptions. Disputes concerning intellectual property rights and claims for injunctive relief are not subject to the arbitration provision. Nothing in this section limits rights that cannot be waived under applicable law, including rights under your Home Improvement Contract.

Corrections And Disclaimer.

There may be information on the Services containing typographical errors, inaccuracies, or omissions; we reserve the right to correct them and to update information at any time without notice. The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitations Of Liability.

To the fullest extent permitted by law, Abodu Homes and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services. Our aggregate liability for any claim relating to the Services will not exceed one hundred dollars. This limitation applies to website use only and does not limit or modify any rights or remedies under a signed Home Improvement Contract.

Indemnification.

You agree to defend, indemnify, and hold Abodu Homes harmless from claims arising out of your use of the Services, your breach of these terms, or your violation of law or the rights of a third party.

User Data.

You are responsible for any data you transmit through the Services. Although we perform routine backups, we are not liable for loss or corruption of transmitted data.

Electronic Communications, Transactions, And Signatures.

Visiting the site, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that electronic agreements, notices, disclosures, and records satisfy any legal requirement that a communication be in writing.

SMS Text Messaging.

Miscellaneous.

These terms and any policies posted on the Services constitute the entire agreement between you and us. Our failure to enforce any provision is not a waiver. If any provision is found unlawful or unenforceable, it is severable and does not affect the remaining provisions.
