Sell Your ADU Like A Condo: AB 1033 In San Jose.
San Jose is the first city in the country to adopt AB 1033, the 2023 California law that lets cities allow homeowners to sell an ADU separately from the primary residence as a condominium. In every other market an ADU is a rental or a guest house. In San Jose it can also be a sellable asset with its own title.
That gives a San Jose Abodu three exits instead of one: rent it at market (see the numbers above), house family, or convert under the city's AB 1033 process and sell the unit on its own while keeping your home. Conversion runs through California's condominium framework, including a recorded condominium plan and lienholder consent, so involve a title company or real estate attorney early.
